The 2025 updates to the FBI’s National Incident-Based Reporting System (NIBRS) User Manual, particularly the redefinition of “Fondling” as “Criminal Sexual Contact”, have sparked urgent questions for campus safety, Title IX, and Clery compliance professionals. These changes, while intended to improve law enforcement clarity, may unintentionally disrupt the alignment between federal crime definitions and institutional sexual misconduct policies.
This session will unpack the legal and operational implications of these definitional shifts, focusing on how they intersect with the Clery Act’s crime classification requirements and Title IX’s regulatory framework. Participants will explore the statutory link between Title IX and Clery via 20 U.S.C. § 1092(f)(6)(A)(v) and examine how misalignment between law enforcement terminology and campus policy language can create confusion, compliance risk, and procedural delays.
Through case examples, policy comparisons, and practical guidance, attendees will learn how to proactively assess and update institutional definitions, coordinate across departments, and ensure that campus responses to sexual misconduct remain legally sound, trauma-informed, and student-centered, even as federal language evolves.
